PRIVATE CLASSES

TERMS AND CONDITIONS

This document is not a service contract that requires students to take classes or Our Spanish Learning to teach them. 

Terms and conditions of the private classes includes three parts: 1) Terms and Conditions related to the student, 2) Terms and Conditions related to notifications, and 3) Terms and Conditions related to Our Spanish Learning. 

  1. People who want to be students must accept our Privacy Policies and Terms and Conditions registered in Spanish language, during the diagnostic process. 
  2. Student must complete the enrollment process that includes: Diagnostic process and definition of class schedule. 
  3. The enrollment process must be carried out by legal guardian when th student is 13 years of age or older but is still a minor. 
  4. In no way, completing the diagnostic process requires students to receive lessons or Our Spanish Learning to teach them. The lesson will depend on: Diagnostic Results and available schedule of Our Spanish Learning, and the acceptance by the student of our Privacy Policies and Terms and Conditions. 
  5. Students must show interest in learning during their educational process. This can be demonstrated taking into account the attention given in class, active participation, and following the learning recommendations. 
  6. Given that the technological platforms that will be used in teaching-learning process will be GOOGLE® Drive and Meet, and PayPal® for payment, the person registering must have GOOGLE® and PayPal® accounts.
  7. The diagnostic costs USD $37 (unless there is an offer on Spanish Online page), one hour of regular class costs USD $26 (except with discounts), and one hour of intensive class costs USD $28. They include taxes. The diagnostic must be paid for prior to receiving the Diagnostic Results. The classes can be paid before class or during the week of classes. 
  8. If the student cannot attend a scheduled class, they must give 24 hours’ notice. If the student does not notify about her/ his absence at least 24 hours before the class, the class must be charged.
  9. Virtual classes are considered formal classes, as if they were in face to face system. Therefore, the student should have her/his audio and video turned on during class and consider other aspects such as suitable place, suitable clothes, and vocabulary as well.  
  10. Students must not share personal data of the professor obtained in the teaching-learning process, unless such information is required or permitted by law. Nor must they record classes. 

II. Terms and conditions related to notifications.

  1. When someone wants to receive notifications from Our Spanish Learning without being a student, her or his personal data are strictly confidential and will not be shared.
  2. The notifications are addressed to adults or people of 13 years old or more but minors with the permission of their legal guardian.
  3. The notifications are related to news of Our Spanish Learning, interesting data about Spanish language, interesting data related to Costa Rica, and congratulations on celebrations.
  4. The person can renounce to receive our notifications at any time.
  1. Our Spanish Learning must comply with the Privacy Policies.
  2. Our Spanish Learning must comply with the enrollment process (if the schedule is available). The enrollment process includes the diagnostic process and definition of class schedule.
    1. For diagnostic process, Our Spanish Learning will give to interested person access to a file. In this, there will be a document with links to complete the diagnostic and the acceptance of our privacy policies and terms and conditions. Also, into this file, Our Spanish Learning will add two documents more: Diagnostic Results and Spanish Learning Plan. The diagnostic will include the skills for Spanish course or classes with an emphasis. 
    2. Our Spanish Learning will share to student the available schedule to define the class schedule. 
  3. Our Spanish Learning must comply with the teaching-learning process:
    1. The studen’s study file will be completed. This will have the Diagnostic Results, Spanish Learning Plan, the Development of Spanish Learning, and the Acceptance of our Privacy Policies and Terms and Conditions. Also, it will have another file: Learning Resources File.
    2. Classes must correspond to Diagnostic Results and Spanish Learning Plan.
    3. The classes will be taught in the schedule agreed with the students through the defined technological means.
    4. It is considered that students drop out when 15 days have passed since their last communication, or when they renounce consent for using their name and address. In this case, the class schedule will be available to another student. If students who dropped out want to return, they can do so if they accept our Privacy Policies and Terms and Conditions, and if Our Spanish Learning has available schedule. 
  4. Other considerations:
    1. Billing in Costa Rica is possible with a factura or with tiquete electrónico. In the event that the students want a factura, they must share the mandatory information to do so: the type of identity document, their document number, their full name, and their email. If the students do not request factura, Our Spanish Learning will make tiquete electrónico. They both are legal invoices.
    2. Updates to the Legal Notice, Terms and Conditions, and Privacy Policies will be posted here without prior notice. However the prices, terms, and conditions accepted when you paid for the classes will continue unchanged for those classes.

CHALLENGE #1

Terms and Conditions when the course is purchased through a PayPal button.

  1. Refund Policy: You can reclaim your money back within 48 hours after your payment if you do not receive the course with its password within the first 24 hours after your payment by writing to [email protected]. Your payment will be verify with PayPal and the course delivery with Our Spanish Learning administration. The refund amount includes transfer costs.
  2. Privacy terms:
    1. Your email address or any of your personal information will not be sold. Your personal data is strictly confidential and it will not be shared in any way except when it is required or permitted by law. Your email address will be deleted from our database 30 days after payment if you purchase the course for personal use, or when your professional use period ends. 
    2. You will not receive promotional messages from us. However, if you have any questions, we can answer them if you do them by the course email address. 
    3. If you purchase the course for personal use, the course and its password will be sent once to your email. If you purchase the course for professional use, the course and its password will be sent to your email every month as long as the payment is complete. 
  3. Payment aspects:
    1. The payment is through PayPal buttons.
    2. If you purchase the course for personal use, it costs $30.
    3. If you purchase the course for professional use for a year, it costs $240, or $80 for four months. 
  4. Security aspects:
    • 1. This website is protected by CloudFlare. 
    • 2. Your browser will not receive cookies or tracking codes from this website when you are browsing on it. However, when you introduce the password of the course, this website by default will put cookies in your browser to remember your IP and avoid asking for the password every time you access. You can disable them from your browser preferences. 
    • 3. This website is updated frequently. 
  5. Updates: Changes in prices, terms, and conditions will be posted here without prior notice. However the prices, terms, and conditions accepted when you paid for the course will continue without change as long as the time of the course is valid for you.

Terms and Conditions when the course is purchased through a printed code.

  1. Course validity period: Challenge #1 course will be valid for you for a month after activating the printed code.
  2. Refund Policy: We do not offer refund policy when the course is acquired by a printed code. However, due to the code is one-time-use, if you try to activate it and have problems, please write to us at [email protected] We will verify with Our Spanish Learning administration if that has already been activated or not.
  3. Privacy terms:
    1. Your email address or any of your personal information will not be sold. Your personal data is strictly confidential and it will not be shared in any way except when it is required or permitted by law. The email address used to send the course will be deleted from our database 30 days after activating the code.
    2. You will not receive promotional messages from us. However, if you have any questions, we can answer them if you do them by the course email address.

TÉRMINOS Y CONDICIONES DE LAS CLASES PRIVADAS

I. Términos y condiciones relacionadas al estudiante:

Este documento no constituye un contrato de servicios que obligue al estudiante a recibir lecciones ni a Our Spanish Learning a enseñarlas. 

Los términos y condiciones de las clases privadas incluyen tres partes: 1)Términos y Condiciones relacionadas al estudiante, 2) Términos y Condiciones relacionadas a notificaciones, y 3) Términos y Condiciones relacionadas a Our Spanish Learning.

  1. Las personas que deseen ser estudiantes, deben aceptar nuestras Políticas de Privacidad y Términos y Condiciones según están registrados en idioma español, durante el proceso de Diagnóstico. 
  2. Las personas que deseen ser estudiantes, deben completar el proceso de matrícula, que incluye: Proceso de Diagnóstico y definición de horario de clase. 
  3. El proceso de matrícula debe ser hecho por un tutor legal cuando la persona estudiante tenga 13 años de edad o más pero aún sea menor de edad. 
  4. En ninguna forma, completar el proceso de Diagnóstico obliga al estudiante a recibir lecciones o a Our Spanish Learning a enseñarlas. Las lecciones dependerán de los Resultados del Diagnóstico y de la disponibilidad del horario por parte de Our Spanish Learning, y por parte del estudiante, de aceptar nuestras Políticas de Privacidad y Términos y Condiciones. 
  5. Las personas que deseen ser estudiantes, deben mostrar interés en aprender, a lo largo del proceso educativo. El interés puede ser demostrado tomando en cuenta la atención prestada en clase, la participación activa y el seguimiento de recomendaciones de aprendizaje. 
  6. Ya que las plataformas tecnológicas usadas en el proceso de enseñanza-aprendizaje serán Drive y Meet de GOOGLE®, y PayPal® como medio de pago, la persona que realiza la matrícula deberá tener una cuenta en GOOGLE® y una cuenta en PayPal®.
  7. El costo del diagnóstico es de USD $37 (a menos que haya una oferta en la página Spanish Online), una hora de clase regular cuesta USD $26 (excepto con descuento), y una hora de clase intensiva cuesta USD $28. Los impuestos están incluidos. El diagnóstico debe ser pagado antes de recibir los resultados del mismo. Las clases pueden ser pagadas antes de la clase o durante la semana de clase. 
  8. Si el alumno no puede asistir a una clase programada, debe avisar con 24 horas de antelación. Si el estudiante no avisa acerca de su ausencia al menos 24 horas antes de la clase, la clase debe ser cobrada.
  9. Las clases virtuales son consideradas clases formales, como si fueran presenciales, por lo que el estudiante deberá tener su cámara y audio conectados durante la clase, y considerar otros aspectos como un lugar apropiado para conectarse, vestimenta apropiada y vocabulario apropiado también. 
  10. Los estudiantes no podrán compartir información personal de la profesora obtenida en el proceso de enseñanza-aprendizaje, a no ser que sea requerida o permitida por la ley. Tampoco pueden grabar clases.

II. Términos y condiciones relacionadas a notificaciones.

  1. Cuando una persona quiera recibir notificaciones de Our Spanish Learning sin ser un estudiante, sus datos personales serán estrictamente confidenciales y no serán compartidos.
  2. Las notificaciones están dirigidas a personas adultas o personas de 13 años de edad o más pero aún menores, con el permiso de sus tutores legales.
  3. Las notificaciones están relacionadas a noticias acerca de Our Spanish Learning, datos interesantes acerca del idioma español, datos interesantes acerca de Costa Rica, y felicitaciones en días festivos.
  4. La persona puede renunciar a recibir nuestras notificaciones en cualquier momento.

III. Términos y condiciones relacionadas a Our Spanish Learning.

  1. Our Spanish Learning deberá cumplir con las Políticas de Privacidad según se registran en idioma español. 
  2. Our Spanish Learning deberá cumplir con el proceso de matrícula en tanto haya cupo disponible. El proceso de matrícula incluye el diagnóstico y la definición de un horario de clase.
    1. Para el diagnóstico, Our Spanish Learning le dará a la persona solicitante acceso a una carpeta. En ella habrá un documento con enlaces para completar el diagnóstico y la Aceptación de nuestras Políticas de Privacidad y Términos y Condiciones. Además en ella, Our Spanish Learning agregará dos documentos, aproximadamente a la semana de recibidas las respuestas de los enlaces: Resultados del Diagnóstico y el Plan de Aprendizaje de Español. El diagnóstico incluirá las habilidades mínimas requeridas según el servicio solicitado (curso de Español o Clases con Énfasis).
    2. Para definir el horario de clase, Our Spanish Learning le compartirá al estudiante el horario disponible a ese momento. 
  3. Our Spanish Learning deberá cumplir con el proceso de enseñanza-aprendizaje:
    1. La carpeta de estudio compartida con el estudiante será completada. Ésta tendrá los Resultados del Diagnóstico, el Plan de Aprendizaje de Español, el Desarrollo del Plan de Aprendizaje, y la Aceptación de nuestras Políticas de Privacidad y Términos y Condiciones. También tendrá otra carpeta que contendrá los Recursos de Aprendizaje del estudiante (y cualquier otro material necesario).
    2. El desarrollo de las clases debe corresponder con los Resultados del Diagnóstico y el Plan de Aprendizaje del Español.
    3. Las clases deben impartirse en el horario acordado con el estudiante y usando los medios tecnológicos definidos.
    4. Se considera que una persona estudiante abandona sus clases cuando pasan 15 días desde la última comunicación del estudiante o cuando renuncian al consentimiento de uso de su nombre y correo. Ante esto, el horario se habilitará para otro estudiante. Si el estudiante deseara continuar después de haberse retirado, podría hacerlo en tanto acepten nuestras Políticas de Privacidad y Términos y Condiciones, y en tanto Our Spanish Learning tenga horario disponible. 
  4. Otras consideraciones:
    1. La facturación en Costa Rica es posible realizarla con factura o con tiquete electrónico. En caso de que la persona que aplique el diagnóstico o el estudiante quiera factura por sus pagos, deberá compartir los datos obligatorios para hacerlas (el tipo de documento de identidad, su número de documento, su nombre completo y su correo electrónico). Si el estudiante no solicita facturas de sus pagos, Our Spanish Learning hará tiquetes electrónicos.
    2. Cuando haya actualizaciones del Aviso Legal, de las Políticas de Privacidad, y de los Términos y Condiciones se publicarán aquí sin previo aviso. Sin embargo, los precios, términos y condiciones aceptados por los estudiantes se mantendrán sin cambios mientras se enseñen dichas clases.

Términos y condiciones de CHALLENGE #1 cuando es adquirido a través de un botón de PayPal.

  1. Política de reembolso: Usted puede reclamar su dinero de vuelta dentro de las 48 horas después de su pago si usted no recibe el curso con su contraseña en las primeras 24 horas después de su pago, escribiendo a [email protected]. Su pago será verificado con PayPal para reembolsarlo tan pronto como sea posible. El monto de reembolso incluye el costo de las transferencias.
  2. Políticas de privacidad:
    1. Su dirección de correo electrónico o cualquier dato de su información personal no será vendido. Su información personal es estrictamente confidencial y no será compartida en ninguna forma excepto cuando sea requerido o permitido por la ley. Su dirección de correo electrónico será borrado de nuestra base de datos 30 días después de su pago si usted adquiere el curso para uso personal, o cuando su periodo para uso profesional termine.

    3. Si usted adquiere el curso para uso personal, el curso y su contraseña será enviado una vez a su correo electrónico. Si usted adquiere el curso para uso profesional, el curso y su contraseña será enviada a su correo electrónico cada mes en tanto el pago lo cubra.

  2. Política de reembolso: No ofrecemos reembolso cuando el curso es adquirido por medio de un código impreso. Sin embargo, debido a que el código es de un sólo uso, si usted trata de activarlo y tiene problemas, por favor escríbanos a [email protected] Nosotros verificaremos con la administración de Our Spanish Learning si el código ya fue activado o no.
